1. CONTEST PHASES:

1.1 The Apps4Ottawa Contest (the “Contest”) is administered by the City of Ottawa (“City”) and consists of the following two phases collectively referred to as the "Contest Period":

  1. The first phase of the Contest begins at 10:00 a.m. EDT on March 11, 2013 and closes at. 10:00 a.m. EDT on May 13, 2013, (the "Submission Period"); and 
  2. The second phase of the Contest begins at 10:00 a.m. EDT on May 13, 2013  and closes at 5:00 p.m. EDT on May 31, 2013 (the "Selection Period"). 

1.2 During the Submission Period, you may register online at http://www.apps4ottawa.ca (the "Contest Website") and complete a submission for an internet based or mobile device based Application (an “Application) or Data Analysis and Visualization (a “DAV”) designed to enhance the City of Ottawa (each a "Contest Submission").

1.3 During the Selection Period, (i) you may vote online for the Contest Submission(s) that, in your opinion, are beneficial to residents or visitors of Ottawa, and (ii) at the same time, four panels of judges (the "Panels") will review and evaluate all Contest Submissions.

2. HOW TO PARTICIPATE: NO PURCHASE NECESSARY

2.1 During the Contest Period, visit the Contest Website and create a registered user account. Registration is free. To register you must include your first and last name and e-mail address. All requested registration information must be provided and be truthful and accurate for Contest entries to be valid. You must comply with the Terms of Use of the Contest Website by ensuring you only create and use one (1) registered user account on the Contest website and do not attempt to alter, modify, or damage the Contest Website. 

2.2 During the Submission Period and after you have registered and logged into the Contest Website you will be able to enter a Contest Submission. There is no limit to the number of  Contest Submissions that you may enter during the Contest Period.

2.3 During the Selection Period, individuals registered and logged into the Contest Website may vote online for Contest Submissions. Each individual is permitted only one vote per Contest Submission but may vote for as many Contest Submissions as they wish. Non-contestants in the Competition interested in the competition are encouraged to register and vote. Public voting will determine the winners of the People’s Choice Awards and Microsoft Windows 8UI Application Awards.

2.4 Entries will be deemed to be made by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned an email address by an Internet service provider or other organization (e.g. business, educational institution, etc.) that is responsible for assigning the email addresses for the domain associated with the submitted email address. Individuals may be required to provide the City with proof that he or she is the authorized account holder of the email address.

3. ELIGIBILITY TO ENTER A CONTEST SUBMISSION

3.1 To be eligible to enter a Contest Submission you must at the time of submitting your Contest Submission Form on the Contest Website: (a) be a resident of a province or territory of Canada; (b) an individual who has reached the age of majority in your province or territory of residence; and (c) have a valid email account registered in your name as described above in section 2.4.

3.2 Members of the judging Panel are not eligible to enter a Contest Submission or be considered for any prizes.

3.3 City employees and contractors and any immediate family members or persons they are domiciled with are not eligible to be considered for or receive any monetary prizes. “Immediate family member” means parents, sisters, brothers, children, husband and wife. The Director of the City’s ServiceOttawa department will provide a non-monetary recognition of the best City Employee/Contractor Contest Submission.

3.4 All personal and other information required by and supplied to the City for the purpose of participating in this Contest must be truthful, complete, accurate and in no way misleading. The City, in its sole discretion, reserves the right to disqualify an individual from the Contest should any individual participating in the Contest at any stage supply untruthful, incomplete, inaccurate or misleading information and/or personal details.

3.5 The City will have the right at any time to require, from any individual participating in this Contest, proof of identity and/or eligibility to participate. Failure to provide proof within a reasonable time could result in disqualification of the individual from the Contest.

4. CONTEST SUBMISSION REQUIREMENTS

4.1 A Contest Submission Form must be submitted through the Contest Website for each Application or DAV entered in the Contest. The Contest Submission Form is available after you register and log into the Contest Website and may be completed in either French or English. All Contest Submission Forms will be retained by the City. All information that you provide must be truthful and accurate in order for your Contest Submission to be considered valid. Each Contest Submission Form must contain the following information:

  1. Your full name 
  2. Your email address
  3. Your complete street address including your postal code
  4. The province or territory to which you reside
  5. Name of Application or DAV; 
  6. Select the category the Contest Submission is to be considered for. The Contestant must select one of the following four categories: 


    Category

    Description

    Category 1: On The Move

    Transit and transportation related applications designed to make it easier for people to get around the city.

    Category 2: Having Fun

    Applications aimed at leisure and fun in Ottawa.


    Category 3: Your City


    Applications designed to encourage people to understand what is happening in their city, get involved, and connect with others.  

    Category 4: Data Analysis & Visualization


    Digital presentations and analysis of data that help to provide better understanding of the City. 


  7. Select the Platform of your Contest Submission (Android, iOS, Blackberry, Microsoft 8 UI, or Web, or Other) 
  8. Provide a working URL where your Contest Submission will be accessible with clear instructions for accessing the Application;
  9. Descriptive summary of the purpose of your Application or DAV and how it works; 
  10. Descriptive summary of the value it provides to residents of Ottawa;
  11. Specify the OpenData sources used by the Application or DAV;
  12. Select the checkbox labeled “I’m a student” if you are a “Student”, defined as an individual who is, at the time of registering at the Contest website, enrolled as a full time student at an educational institution in Canada that is either a Public or Private College, Community College, Institute of Technology, University or Secondary School; and
  13. Select the checkbox labeled “I’m a City employee or contractor” if you are currently a City employee or contractor.

4.2 Your Application Submission may be for smart phones, mobile devices, or PC computers. If any functionality or text of an Application is in a language other than English or French, the Application Submission must be accompanied by an English or French translation of that text. 

4.3 Your DAV must be in electronic and available for download from the URL that you specified in the Contest Submission Form.  If any text included in the DAV is in a language other than English or French, the DAV must be accompanied by an English or French translation of that text.

4.4 Applications and DAVs are required to use at least one data set from the City’s Open Data Catalogue that may be found at: http://app06.ottawa.ca/en/city_hall/statisticsdata/opendata/info/index.htm .

4.5 After the close of the Submission Period and up until the end of the Selection Period, you are not permitted to make or allow to be made any changes or alterations to Application(s) that you submit.

4.6 Your Application or DAV must be hosted and publicly available on your website or a third-party website as of the start of the Selection Period up to and including the end of the Selection Period for public voting and judging purposes. There must be no cost to accessing your DAV. If there is a cost to acquiring the Application, the cost is required to be under $5.00 Canadian Dollars.  The City encourages you to maintain your DAV or Application for a period of 6 months following the Contest Period. Contest Winners, in consideration of being selected as a Contest winner, must agree to make their winning Application or DAV publicly available for three months after the date the release referred to in section 8.2 below is signed. Please ensure that you submit your applications to third  party websites including Application Stores well in advance of the contest deadline, as some of these websites delay the availability of submitted applications. The City will not extend the contest deadline to accommodate any individual whose application has not been made publicly available by the start of the selection period.

4.7 You retain ownership of your Contest Submission and are permitted to sell the use of your Contest Submission commercially after the Contest Period if you choose to do so.

4.8 You represent and warrant that: (a) your Contest Submission is your original work (b) your Contest Submission is free of any known virus or malware (c) any data sets and any other third party material of any kind of nature whatsoever that is incorporated into or was used to create your Contest Submission, has been provided to you or obtained by you from the rightful owner with all necessary permissions, rights or licenses, including without limitation the permissions, rights and licenses necessary to grant to the City the licensing rights set out in section 4.6 above; and (c) your Contest Submission does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property rights of any person or entity.

4.9 Contest Submissions containing any matter which in the sole discretion of the City are deemed as indecent, defamatory, offending, or demonstrates a lack of respect for public morals or conduct, or which adversely effects the public image or reputation of the City will not be accepted and disqualified.

4.10 The City may disqualify any Contest Submission that it determines, at its sole discretion, do not meet these Contest Submission Requirements. The City may also, at its sole discretion, disqualify any Contest Submissions that are identical or nearly identical to Contest Submissions that have already been submitted through the Contest Website or that won a prize in the 2010-2011 Apps4Ottawa Contest. 

5. PRIZES

5.1 The prizes will include 24 cash prizes (4 × $3,000; 4 × $2,000; 8 x $1,500; 5 × $1,000 ; 1 x $500; 1 x $350; 1 x $150) for a total of $38,000 in cash prizes. Information about how to win the prizes is described is described in sections 6, 7, and 8 below. Information about how the City will notify prize and confirm prize winners is described in section 9 below. 

5.2 All selected Contest winners are solely responsible for use of their prize. Prizes must be accepted as awarded and cannot be transferred, substituted or redeemed for cash. The City reserves the right, in its sole discretion, to substitute any and all of the prizes for prizes of equal value if a prize cannot be awarded as described. The City will not be responsible, however, if factors beyond the City's reasonable control prevent prizes from being awarded. In any such event, no substitute prizes or cash equivalents will be provided. Prizes will only be delivered to the verified winner.

5.3 The City reserves the right not to award prizes, or to award only some of the prizes, if there are not a sufficient number of eligible Contest entries, or if, for any other reason, there is a not a sufficient number of individuals to whom the prizes can be awarded. The City also reserves the right, in its sole discretion, to select an alternate Contest winner from the eligible entries should any selected individual be unable or unwilling to comply with these Official Rules, or otherwise unable or unwilling to accept the offered prize.

6. HOW TO WIN A PANEL PRIZE FOR A CONTEST SUBMISSION

6.2 At the start of the Selection Period, the Category 1, Category 2, and Category 3 Panels (4), each consisting of two City Officials, one member of Council, one Sponsor representative, and one member of the academic community will evaluate each Application under its respective category and will apply the following criteria to each Application:

  1. Usefulness – utility to citizens of Ottawa overall, or any particular demographic of users in Ottawa 
  2. Support of City Priorities the degree to which an application supports the priorities outlined in the 2011-2014 City Strategic Plan 
  3. Ease of use – the overall usability of the application 
  4. Access – ability for the application to be used by the broad array of citizens 

6.3 At the start of the Selection Period, the Category 4 Panel, consisting of two City Officials, one member of Council, one Sponsor representative, and one member of the academic community will evaluate each DAV and will apply the following criteria to each DAV:

  1. Usefulness – utility to citizens of Ottawa overall, or any particular demographic of users in Ottawa 
  2. Support of City Priorities the degree to which an application supports the priorities outlined in the 2011-2014 City Strategic Plan 
  3. Ease of Understanding – the degree to which one can understand the submission 
  4. Creativity– Degree of creativity that can be ascribed to the submission 

6.4 The Panels will select winners of twelve (12) Gold, Silver, and Bronze Category Prizes by applying the criteria in sections 6.2 and 6.3 above to determine the three (3) best Contest Submissions in each of the four (4) categories. The rankings for each of the five categories are Gold ($3,000), Silver ($2,000), and Bronze ($1,000). 

6.5 The Panels will select winners of the four (4) Student awards by applying the criteria in sections 6.2 and 6.3 above to select the best Contest Submission in each category that was submitted by an individual who, when submitting their Application, self-identified as a Student as defined in section 4.1 of these Rules. The individual must have been a Student at the time of completing the Contest Submission Form, defined as an individual who, at the time of the Contest Submission Form was submitted, was enrolled as a full time student at an educational institution in Canada that is either a Public or Private College, Community College, Institute of Technology, University or Secondary School. An individual may win a Student Prize and a Gold, Silver, or Bronze Panel Prize for the same Contest Submission. 

7. HOW TO WIN PEOPLE’S CHOICE PRIZES

7.1 The People’s Choice Prizes are:

7.2 The winners of the People’s Choice Prizes will be based solely on the voting of registered visitors to the Contest Website during the Selection Period. The individual who’s Contest Submission receives the most votes within a category will receive the People’s Choice Award for that category in the amount of $1,500. If there is a tie between two or more Contest Submissions, the prize will be split equally amongst the tied individuals. The recipient of a People’s Choice Prize may win other prizes in the Contest for the same Contest Submission.

8. HOW TO WIN MICROSOFT WINDOWS 8UI APPLICATION PRIZES  

8.1  The Microsoft Windows 8 UI Applications are: 1x $1,000 1 x $500; 1 x $350; and 1 x $150.

8.2 The winners of the Microsoft Windows 8 UI Application Prizes will be based solely on the voting of registered visitors to the Contest Website during the Selection Period. The four Microsoft Windows 8 UI Applications that receive the most votes, regardless of category in which they were entered, will receive prizes of most popular ($1,000), second most popular ($500), third most popular ($350), and fourth most popular ($150). A recipient of a Microsoft Windows 8 UI Application Prize may win other prizes in the Contest for the same Application Submission

9. NOTIFICATION AND CONFIRMATION OF PRIZE WINNERS

9.1 The City will contact the selected winners of Contest Submission Panel Prizes, Microsoft Windows 8UI Application Prizes, and the People’s Choice Awards for five (5) consecutive working days during the month of June 2013 using the email address contact information provided through the ContestWebsite. If no response is received by the end of that period, another winner will be selected.

9.2 Before being confirmed as a prize winner, each individual who satisfies the requirements for their respective prize will be required to execute a legal agreement and release ("Release") that confirms that the individual: (a) is eligible to participate in the Contest; (b) agrees to comply with these Official Rules, (b) accepts the prize(s) as offered; (c) releases the City and sponsors of the Apps4Ottawa Contest including their respective servants, agents, employees, contractors, licensees, and assignees from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Contest, or the acceptance, possession, use or misuse of any prize, including without limitation costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, or from any and all claims of third parties arising therefrom; (d) grants to the City the unrestricted right to publish without any further compensation the name, City of residence, photographic image, business name (if applicable), and educational institution that you attend (if applicable) and any website dissemination or broadcast thereof of that individual for the purposes of advertising and promoting the Contest and awarding and publishing the prizes; and (e) agrees to make their winning Application publicly available for three months after the date the Release is signed. The Release document may contain such other terms and conditions as the City, in its sole discretion, may decide. The Release document must be returned to the City by the date indicated on the document or the prize(s) will be forfeited and another Contest entry may be selected.

9.3 Cash Prize winners must answer a skill-testing mathematical question in order to receive his/her prize.

9.4 Cash prize winners are encouraged, but not required, to attend the Apps4Ottawa Awards Ceremony to be held in Ottawa, Ontario.

10 GENERAL CONDITIONS

10.1 No responsibility is assumed by The City for lost, late, misdirected, or incomplete entries or any computer, online, telephone or technical malfunctions that may occur in the processing, transmission or receipt of entries.

10.2 The City reserves the right at its sole discretion, to disqualify any individual who tampers with the Contest Website including entry process.

10.3 You agree to abide by the terms of these official rules and by the decisions of the Panel, which are final and binding on all matters pertaining to this Contest. The City and Panel reserves the right at its sole discretion, to disqualify any individual who fails to comply with one or more terms of the official rules.

10.4 The City reserves the right to cancel, modify or suspend the Contest at any time subject to applicable law, if the City determines that the Contest cannot be run as originally planned or if fraud or any other occurrence compromises the fairness or integrity of the Contest.

10.5 This Contest is governed by the laws of Ontario and the laws of Canada applicable therein, and is subject to all applicable federal and provincial laws and regulations. By entering this Contest, the contestant agrees that the courts of the Province of Ontario shall have jurisdiction to entertain any action or other legal proceedings based on any provision of the Rules or the running of this Contest. The contestant hereby irrevocably attorns to the exclusive jurisdiction of the courts of the Province of Ontario.

11 PRIVACY

11.1 By participating in this Contest, you acknowledge that your personal information (including name, address, email address) is being collected by the City for the purposes of operating and administering the Contest and consent to this collection and use of your personal information. You also consent to the City disclosing publicly, including without limitation through the Contest Website, your full name together with the name and description of your Application.

11.2 In the event that you are selected as a Contest winner, you consent to your name, City of residence, photographic image, business (if applicable), and educational institution that your attend (if applicable) being disclosed publicly by the City, including without limitation through the Contest Website and other media accessible to the general public.

10.3 Your personal information is collected under the authority of sections 8 to 10 of Municipal Act, 2001 SO. 2001, c. 25, for the purposes set out in this sections 11.1 and 11.2 of these Official Rules. 12 LIMITATION OF LIABILITY

12.1 By participating in this contest, you agree to release and hold harmless The City and Sponsors of this contest, their parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability or any injuries, loss or damage of any kind arising from or in connection with this contest or prize won.
